Terms of Service
The Plant Medicine People (PMP) products, software, services and sites (referred to collectively as the “Services”), used by our visitors and subscribers (collectively, “You” or “Your”) is subject to these terms and conditions (the “Terms of Use”) and form a binding agreement between You and us. Please review the following Terms of Use carefully. Each time You access The Plant Medicine site or use our Services, you are agreeing to be bound by these Terms of Use. If You do not agree to all these Terms of Use, The Plant Medicine People (PMP) is unwilling to grant You access to the Services, and You must cease access to the Services immediately.
Privacy
You acknowledge our collection of information by You providing us with personal information while using our Services knowingly through registration/application or by emailing us directly or through referrals or third parties/cookies. Personal information includes personal data, contact information, company and business information, and interpersonal information.
“Personal Data” means data that allows someone to identify or contact You, including, for example, Your name, address, telephone number, e-mail address, as well as any other non-public information about You that is associated with or linked to any of the foregoing data.
We may collect Personal Data from You, such as Your first and last name, gender, e-mail and mailing addresses, professional title, company name, and password when You create an Account to log in to our network.
If You order or register for Services, we will collect all information necessary to complete the transaction, including Your name, credit card information, billing information and shipping information.
We retain information on your behalf, such as files and messages that You send us or complete in order to register for a retreat or event.
If You provide us feedback or contact us via e-mail, we will collect Your name and e-mail address, as well as any other content included in the e-mail, to send You a reply.
When You participate in one of our surveys or testimonials, we may collect additional profile information.
We also collect other types of Personal Data that You provide to us voluntarily, such as Your operating system and version, product registration number, and other requested information if You contact us via e-mail regarding support for the Services.
We also use cookies and URL information to gather information regarding the date and time of Your visit and the information for which You searched and which You viewed.
Except as set forth below, the only people who have access to personal information collected on the Sites are PMP Employees and affiliated Coaches, as engaged specifically, who have a need to know and who are bound by nondisclosure agreements and our privacy policy located at http://www.PlantMedicinePeople/terms-and-conditions/. We have physical, electronic, and procedural safeguards to protect the personal information that we store. The only information we would share (solely during introductions or referrals) would be Your name and email.
Also, please note that the Sites may contain links to third party websites. These third party websites may send their own cookies to collect data and solicit personal information. Therefore, we cannot guarantee Your privacy when visiting such third-party sites, nor the accuracy or acceptability of any services provided by such third parties.
Use of Your Information
We use the Personal Data that we receive to provide you with Services requested and including:
Registration for email lists and ongoing Plant Medicine People communications, if opted in and confirmed by You.
Ongoing direct communication relating to registrations for courses, Coaching sessions or retreats. This communication may be via text, email or by phone. Opting out of any of these options is available to You at anytime.
To send retreat, Coaching or courses surveys, offers, and other promotional materials related to our Services and for our other marketing purposes. Opting out of any of these is available to You at anytime.
We do not rent, sell, or share Your personal information with any other entity, except when: we have Your permission; or we respond to subpoenas, court orders, or other legal process; or when we must exercise our legal rights, protect our property, defend against legal claims, or otherwise comply with the law, or we believe it is appropriate in order to investigate, prevent, or take action regarding suspected illegal activities, fraud, threats to personal safety, or violation of these Terms of Use.
In the unlikely event that The Plant Medicine People (PMP) is acquired or transferred, or changes entity status through any type of transaction (including an asset sale, merger or bankruptcy), the personal information will be among the transferred assets.
We reserve the right to remove a user without notice at our discretion if there are reasonable grounds to believe You have breached any of the restrictions above.
Your Personal Data may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Data may be less stringent than the laws in Your country.

Our Limits on Liability during use of The Plant Medicine People (PMP) Services
The Plant Medicine People (PMP) disclaims liability arising out of use of our Services, attendance at a retreat, or any of The Plant Medicine People (PMP) affiliated activities. In no event will we or our officers, employees, directors, parents, subsidiaries, affiliates, agents or licensors be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of revenues, lost registration fees, profits, goodwill, use, data, lost real estate opportunities, or business interruptions or other intangible losses (even if such parties were advised of, knew of or should have known of the possibility of such damages, and notwithstanding the failure of essential purpose of any limited remedy), arising out of or related to Your use of or access to, or the inability to use or to access, the Services (including Your attendance at one of our retreats), regardless of whether such damages are based on contract, tort (including negligence and strict liability), warranty, statute or otherwise.
We will not be liable for any damages arising from the transactions between You and any third-party merchants or service providers or for any information appearing on third party merchant or service provider sites or any other site linked to our Sites.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. In no case shall PMP, Inc. be liable for any costs incurred due to cancellation of events from either party as well as due to acts of God such as natural disasters and other events outside human control.
Without limiting the foregoing, we do not accept any liability for damage to Your computer system or loss of data that results from Your use of the Sites and We cannot guarantee that any files that You download are free from viruses, contamination or destructive features. While we use all reasonable endeavors to correct any errors or omissions as soon as practicable once they have been brought to our attention, We do not warrant that the information on the Sites itself will be free from errors or omissions. We do not warrant that the Website will be available uninterrupted and in a fully operating condition.
Access to the Sites may be suspended temporarily and without notice in the case of system failure, maintenance, or repair or for reasons reasonably beyond our control. All content and services on the Sites are provided on an ‘as is’ and ‘as available’ basis. We do not make any representation or give any warranty, and hereby disclaim all express or implied warranties, in respect of the Sites or its content, including, without limitation, any advice given (on a personal or general basis) and statements made by advertisers on or via the Sites, including without limitation the implied warranties of non-infringement, merchantability, data accuracy, fitness for a particular purpose and quiet enjoyment. Any decisions or action taken by You based on information provided on or via the Sites are at Your sole discretion and risk and You should obtain individual professional advice where necessary.
Conduct During PMP Coaching or Courses
In utilizing our Services, we reserve the right to suspend or terminate, at our discretion, Services for violations of our rules, guidelines, or Terms of Use. Specifically:
By accepting these Terms of Use, You agree that You will not send or distribute unsolicited or unauthorized advertising, promotional materials, junk mail, chain letters, spam, pyramid schemes, or any other type of solicitation to other members, nor will You stalk, harass or unreasonably disturb any other member. This action is grounds to suspend or terminate, at our discretion, a member’s account.
That You will maintain discretion in connecting to other members and acknowledge that any Course or Coaching materials shared with you, including recordings, are not to be shared outside of the Course or Coaching session as they may contain personal information of other members, Coaches and/or sensitive information not meant for distribution.
Conduct During PMP Retreats
All participants and attendees to our Retreats, including You and Your guests, must be approved by The Plant Medicine People (PMP) through advance registration/screening protocols.
We reserve the right to remove attendees who do not comply with the proper registration, security procedures, Release/Activity waivers, or requirements of attendee conduct outlined below at any point during an event and without refund. The Plant Medicine People (PMP) reserves the right to remove anyone who disobeys any requirements, procedures, policies, or regulations of the retreats.
During Your stay at the retreats, you agree to the following codes of conduct:
Respect the medicine and the traditions we work with.
Respect and follow indications and guidelines provided by PMP, Inc. and The Retreat.
Respect the healing process of yourself and others in the group.
Respect the personal boundaries of others in the group.
Respect that everyone is undergoing their own experience and deserves to have their own space and peace and quiet. Please do not vocalize your experience or touch other people during ceremony.
Respect all guests and staff.
We have a ZERO TOLERANCE policy against sexual harassment, misogyny and racism.
Respect that engaging in sexual activity including with yourself as well as married couples/ partners is prohibited.
Intolerable offenses outlined below are zero tolerance and will be subject to removal from the retreat, at the discretion of the retreat staff, without notice or refund.
Sexual harassment toward guests or staff, including verbal and non-verbal insinuation as well as direct physical contact.
Behavior that puts your own or others’ safety at risk, including carrying travel tools such as pocket or utility knives.
Repetitive disruptive behavior inside or outside ceremony that creates discomfort for other guests, or significantly interferes with the healing process of other guests.
Leaving a ceremony before it is over whether partaking of the brew/medicine or not.
Bringing any form of recording equipment including a mobile phone to ceremony.
We have zero tolerance to the use of any substances, whether recreational or otherwise, without the explicit consent of The Retreat Director and/or lead facilitator, inclusive of painkillers, anti-diarrhea or any other medication plant or pharmaceutical.
Leaving The Retreat grounds without prior arrangement (note: prior arrangement does include writing your name on the whiteboard when going to the beach or on a walk during appropriate hours, as discussed during orientation) or explicit consent from The Retreat Director and/or lead facilitator.
International Travel
You are responsible for all travel and requirements to travel, including: meeting all requirements of foreign entry, supplying all necessary documents for travel (passports, visa, etc.), and making sure documents are valid and organized for foreign entry. PMP, Inc. does not have unique understanding or knowledge of your necessary documents for travel, or the foreign entry requirements. We encourage you to carefully check for any prohibitions on travel, warnings, general announcements, and advisories that the government of your travel destination or your country of origin has issued. We advise you to check all of this information carefully prior to booking your retreat and itinerary.
Visas and Passports: Contact the respective Embassy or Consulate for your travels for all Visa and Passport information and requirements. Changes in requirements happen and you should always carefully check to ensure that all your information is current prior to booking your retreat and leaving on your flight. We accept no liability in the event the airline or airport refuses to grant you entry onto the flight, or if you are forbidden entry to a country due to a lack of proper obligations such as a passport, visa, or other documents that might be required for travel. This also applies for countries which may not be your final destination. This includes any situation in which an aircraft stops, even if you stay in the plane or airport.
Health: You must consult with your physician for the required, necessary, and encouraged inoculations for your travel prior to your departure. You are fully responsible for all of the following: taking any and all recommended medications, receiving the required inoculations, meeting entry requirements for health, and following medical advice given for your travel.
PMP, Inc. offers retreats and other products in other countries, but this does not represent or warrant that travel to these areas is either advised or is risk-free. PMP, Inc. is not liable for any damages or losses that may occur or result from traveling to these locations.
Important Notice: PMP, Inc. advises that you do not purchase your flights or any other travel until after you have completed (i) the required booking and health forms, (ii) paid your deposit, (ii) completed the screening and preparation call, and (iv) have received direct confirmation of your reservation from PMP.
Cancellation and Refund Policy
When purchasing Services (Courses, Coaching or Retreats) through our website, it is your responsibility to thoroughly read and understand the cancellation and refund policies as presented as it applies to the specific retreat being purchased. Indemnification
You agree to indemnify, defend and hold harmless PMP, Inc. and its partners, directors, officers, affiliates, agents, contractors, subcontractors, licensors, service providers, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
Unauthorized Uses of Intellectual Property
You may not copy, reproduce, republish, download, post, broadcast, record, transmit, commercially exploit, edit, communicate to the public or distribute in any way the content of the Sites or our materials provided or displayed on a retreat, other than for Your own personal use. Subject to the above, You may download insubstantial excerpts of the Sites’ content to Your hard drive for the purpose of viewing it provided that no more than one copy of any information is made.
We retain the rights to all staff photography and video footage during an Event.
Any use other than that permitted under this clause may only be undertaken with our prior express authorization.
Changes to Terms of Service
We reserve the right to amend these Terms of Use at any time. All such changes will take effect once they have been posted on the Sites and You will be deemed to have accepted any such changes by Your use of the Sites after such time. Disclaimer
PMP, Inc. does not supply, manufacture, distribute or condone the use of any illegal substances. The goal of PMP, Inc. is to facilitate access to experienced and trained shamans who work with sacred plant medicines within an accepted context of ceremony and sacrament. Each guest and their needs are evaluated by PMP, Inc. shamans personally and individually, and the shamans strictly work within the laws of their training and all local and national laws where the retreats will take place.
